Description

WME is looking to receive applications from suppliers to join a multi supplier Open Framework to carry out energy efficiency improvement works in but not limited to any public sector buildings including Schools, Council buildings and Town Councils. It is envisaged that most of the works will be conducted on school buildings.

In May 2024 WME awarded Barker Associates a single supplier framework for Decarbonisation Solutions for the education sector. This framework will broaden WME's decarbonisation services to cut energy use, improve building efficiency, and reach net zero.

In establishing this framework, Barker Associates have supported WME with technical advice and support, including, but not limited to; providing support with drawing up the tender document, technical specifications and will support in subsequent tender evaluations.

Once the framework has been established it is envisaged that Barker Associates will utilise the framework to call off contracts to support their work as our decarbonisation partner. This work will include preparation of ITT documents, supporting with clarification questions, offering technical support and evaluation of the competitive selection process. If the Contracting Authority wishes to utilise their own technical advisors, then the framework will permit that.

During the first 12 months of the award of this framework. WME will only offer the fully managed procurement service to Contracting Authorities utilising Barker Associates consultancy services. This exclusion is designed to ensure any teething problems have been ironed out prior to expanding this service to other consultants/contractors.

Further information about fees

There is a fee for using this framework, The WME fee is a cost payable by the Contracting Authority and recovered from the Supplier. The fee payable to WME depends on the service level route taken, being either; WME managed procurement or self service.

Fees range from 0.5% to 2% in each case the percentage being of the final value of each Call-Off Contract plus any applicable VAT. The Supplier will therefore need to account for this cost when quoting for work.

Framework operation description

This tender establishes a multiple supplier framework agreement for the provision of services as detailed in the specification. Suppliers who are successfully appointed will be added to an approved supplier list.

Contracting Authorities have two options for accessing the framework:

1. Further competition

2. Direct Award

The choice of access route rests solely with the Contracting Authority.

In cases where a Contracting Authority opts for a direct award, all relevant documentation will be made available to support their due diligence process. The Contracting Authority will then place an order directly with the selected supplier.

Service Level 1 - Managed Procurement:

Suppliers enter into a Framework Agreement with WME, and Contracting Authorities access the framework via a Call-Off Agreement. WME will facilitate the publication of required notices via their ESourcing Portal - Delta.

The Authorised User is responsible for defining requirements, drafting specifications, selecting suppliers through further competition or justified direct award, assisting with contract finalisation, and facilitating ongoing contract management.

Service Level 2 - Self-Service Procurement:

As with the managed model, suppliers enter into a Framework Agreement with WME. However, Contracting Authorities independently manage the procurement process. This includes defining requirements, selecting suppliers via a further competition or direct award, and overseeing the full contract lifecycle without involvement from WME. All due diligence responsibilities rest solely with the Contracting Authority and the chosen Supplier.

The intended duration of the Framework is eight (8) years. However, Call-off Contracts awarded under the Framework may extend beyond the Framework's end date.

The Procurement Act 2023 introduces a new 'open framework' model, which allows for the Framework to be reopened at predetermined intervals. This enables new suppliers to join and existing suppliers to amend their participation. We intend to reopen the Framework after year 2 for Scheme 2 and again at year 4 for Scheme 3 then finally at year 6 for Scheme 4.

Suppliers awarded a place on the original Scheme will be given the opportunity to confirm whether they wish to remain on the Framework at each reopening. At that time, suppliers may choose to amend their bids or retain their original submission. All new and amended bids will be evaluated, which may result in changes to Supplier rankings and could affect continued participation or eligibility for direct award opportunities.
