Leicestershire County Council has undertaken a procurement process to identify and appoint a number of service providers to the Short Breaks (Play & Leisure) and Domiciliary Care for Children with Disabilities framework awarded in March 2021, to provide a range of disabled children’s services as described below.

Lot 1: Short Breaks (Play & Leisure) provide opportunities for disabled children and young people to spend time away from their parents and carers, with friends and peers, for positive opportunities.

Lot 2: Domiciliary Care Domiciliary care is a statutory service that the Council has a duty to provide and it relates to the provision of care and support to children and families in their own home (e.g. personal care, meal preparation, moving and handling etc.).

The process to refresh the framework was included in the 2021 Invitation to Tender documents. The purpose of this reopen is to allow additional service providers to join the current list of approved providers.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Recent analysis of spend made against this framework identified that there has been an

increase in spend. This increase is a direct result of the loss of the residential overnight short

breaks provision in Leicestershire. This happened due to Ofsted closing the Residential

Overnight Short Break provision that was contracted to deliver these services, and, a

subsequent tender exercise to replace the provider did not receive any suitable tenders. The

loss of this service has meant that there has been additional demand against this framework agreement, to provide alternative provision, which has resulted in an increased spend. Based on current spend through the framework it is anticipated that the advertised contractual value will be exceeded and modification is required to the overall value to cover the expected increase.

Increasing the resources available through this contract will ensure the Council can continue to fulfil it's statutory duties to provide respite care to families with children who have Special Education Needs and Disabilities.

The modification will increase the contract value by an additional £812,746. This is less than 50% of the original contract value.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The modification meets all the criteria set out in regulation 72(1) C) (i) The need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen - The Council could not have foreseen the issues with the Residential Overnight Short Break provision and that this service would cease to be available in Leicestershire. (ii) The modification does not alter the overall nature of the contract - the modification is to increase funds available through the contract to enable increased demand to be met. The nature of the services supplied will remain the same. (iii) Any increase in price does not exceed 50% of the value of the original contract. - the original total contract value was £2,440,000, the total value of the the modification is £812,746 which is less than 50% of the original framework value.
