The modification for the contract was brought about by necessary additional supplies of plants, trees, and shrubs which were required to complete the bespoke design.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

The design is a creation of Diarmuid Gavin and he holds full intellectual property rights. Diarmuid Gavin was responsible for ordering the plants, trees, and shrubs for this contract due to his specialist knowledge and business relationships in the horticultural community. The plants, trees and shrubs are unique species from various suppliers across Europe. In order to ensure a cohesive and consistent appearance, the plants, trees and shrubs must be ordered from the same suppliers. Therefore, a change of economic operator isn’t possible as Diarmuid Gavin is the only designer with the necessary knowledge and business relationships to order the plants, trees and shrubs without creating a substantial duplication of costs for the Council.
