Contractor for the provision of a vehicle maintenance service, ensuring that all vehicles are kept in safe and roadworthy condition.

The EA requires that all vehicles will be always maintained in accordance with manufacturers’ recommendations, and to ensure compliance with relevant UK, Northern Ireland and European Union Legislations and Regulations to meet the standards set under the DVA Guide to Maintaining Roadworthiness Commercial Goods and Passenger Carrying Vehicles.

EA originally awarded contract TRN-23-010 for period 01/04/2024 – 30/06/2025 which included the built in optional 3-month extension taken between 01/04/2023 – 30/06/2025. EA now propose a further 3-month extension to run from 01/07/2025 – 30/09/2025 which requires an additional contract value to the current contract (an additional £69,700.00) (overall revised contract value will then be £278,800.. . Modification to the Framework is required due to delays in the procurement process which could not have been anticipated and is necessary to ensure ongoing service provision of Vehicle Maintenance and Repair of EA Vehicles in the East Tyrone Area. The additional value is required to cover the unanticipated volume of repairs required under the framework as well as the additional spend required to cover the period of the extension.

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

The modification is permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled:

(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen;

Framework Period Extension - This modification is required due to delays in the procurement process which could not have been anticipated. This is due to the re-structuring of the specification and financial response as delays while dealing with poor supplier performance. The re-tender of this framework is anticipated to be published May 2025.

Modification of framework value – This modification is required to cover the spend over the extended framework period. There has also been an increased demand for the maintenance services which was higher than estimated at the time of award of the framework.

(ii) the modification does not alter the overall nature of the contract.

The proposed modification does not impact the overall nature of the framework which will continue for the Maintenance and Repair of EA vehicles in the East Tyrone Area as detailed in the original specification.

(iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.

The increase in value will not exceed 50% of the original contract value.
