Carmarthenshire County Council is responsible for the safe treatment and disposal of leachate arising from a closed landfill site at Nant-y-Caws, Carmarthen, UK.
The leachate is currently treated via a biological treatment plant prior to discharge to a local river under a Natural Resources Wales issued Permit.
The treatment plant consists of a MBBR (Mobile Bed Biological Reactor) and SAF (Submerged Aerated Filter) that successively treats the leachate to enable consented discharge to the river.
The Council invited tenders for the operation and maintenance of the plant with suitably qualified and technically competent personnel.

seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The duration of the current Contract, which was due to expire on 31/01/2026, has been extended by 10 months.
The Council, in conjunction with the incumbent plant operator has been required by Natural Resource Wales (NRW) to install a new denitrification reed bed to reduce nitrate levels and ensure the treatment plant does not breach its environmental permit conditions. It is anticipated that all works will be completed by early 2026. However, the process requires on-going input from the incumbent operator (who developed the reed bed) as the reed plants and microbes need a full growing season to mature before they become fully effective at reducing nitrate levels and a reed bed permit variation cannot be sought from NRW until sufficient data has been gathered to support the application. This is likely to be late summer 2026 at the earliest. In addition, additional time will be required to apply and receive approval from NRW.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
The term of the Contract is being modified in accordance with Regulation 72(1)(b) of the Public Contracts Regulations 2015 (under which the contract was let) as these are additional works which have become necessary and were not included in the initial procurement. A change of operator at this stage cannot be made for economic and technical reasons due to the requirements of interchangeability or interoperability with existing installations procured under the initial procurement. A change of operator would also cause significant inconvenience and substantial duplication of costs for the Council.
