Description

The Environmental Protection Act 1990 allows Chichester District Council (CDC), Adur District Council and Worthing Borough Council (A&W) (collectively referred to as 'the Councils' in this document) to collect commercial waste from businesses and a charge to be levied for this service. The Councils business waste and recycling service is well established, has a good local reputation and has successfully expanded in recent years.

The Councils have a duty to ensure all waste collected is properly disposed of and must therefore have a contract in place with a supplier to provide processing and disposal services. (Waste duty of care: code of practice (accessible version) - GOV.UK)

Payment terms

Chichester District Council

Invoices should be submitted to invoices@chichester.gov.uk and must include a valid Purchase Order number as supplied by the Council.

If any discrepancies or issues are identified, the council will notify the service provider within 10 working days of receiving the invoice. The notification will include details of the dispute, and any supporting information required to resolve the matter. Payment of the disputed amount may be withheld until the issue is resolved.

Adur and Worthing Council

Invoices should be submitted to payments@adur-worthing.gov.uk and must include a valid Purchase Order number as supplied by the Council.

Description of risks to contract performance

Ethical / Legal Disposal of Waste

Suppliers must dispose of all waste legally and with environmental considerations being factored in. Not doing so causes huge political risk as well as environmental impact. Suppliers will be targeted on reducing waste that is sent to landfill as well as ensuring compliancy to the following:

  • The Environmental Protection Act 1990,
  • The Waste (England and Wales) Regulations 2011,
  • The Environment Act 2021,
  • The Landfill Directive,
  • Animal By-Products Regulations

Future regulations will also need consideration:

  • Digital Waste Tracking (from April 2026)

As well as the above, suppliers should hold a waste carriers licence

Reduced Control

Outsourcing of waste disposal means the Authority have little visibility or direct control over how waste is disposed or volumes taken by suppliers. Suppliers will have KPI's written that monitors data reporting and acceptance of waste.

Increased Rates of Disposal

The marketplace for disposal of waste is small and with more and more waste being produced, and more requirements coming into force (food waste collection) the volumes will increases. This 'supply and demand' type economy may drive costs up to the Councils. any price rises will in line with fair market rates or aligned to the relevant pricing index and agreed by the Councils.
