Description

CPC intends to create a fully compliant, flexible and future-ready framework for new-build or refurb capital projects in the education and wider public sectors.

Any resulting framework from this exercise will be available to Further Education Institutions, Universities, Sixth Forms, Academies, Schools, Museums and other similar organisations who are CPC Members (https://www.thecpc.ac.uk/members/regions.php) and all CPC future members (https://www.gov.uk/guidance/get-information-about-schools).

Local Authorities may also wish to use the resulting framework when procuring on behalf of Educational Establishments.

The framework will also be available to the Wider Public Sector https://www.thecpc.ac.uk/suppliers/eligible-public-sector-bodies.php).

Competitive flexible procedure description

This procurement will be conducted using a Competitive Flexible Procedure in accordance with Section 20 of the Procurement Act 2023. The procedure has been designed to ensure compliance with the Act while providing the Contracting Authority with the flexibility required to structure a process proportionate to the subject matter and complexity of this procurement.

The process will comprise multiple stages:

  1. Selection Stage: Bidders will be assessed to determine whether they are excluded or excludable suppliers under the Act and whether they meet the stated conditions of participation. Following evaluation, only the ten (10) highest scoring compliant bidders per Lot will be invited to progress to the next stage.
  2. Dialogue Phase: Shortlisted suppliers will be invited to engage in structured dialogue to refine aspects of the procurement, including the approach to call-off contracts (based on the NEC and JCT suites), the framework conditions and the framework fee structure.
  3. Final Tender Stage: Following dialogue, the Contracting Authority may issue clarifications or amendments to the procurement documents. Bidders will then be invited to submit final tenders, which will be evaluated against published qualitative and commercial criteria.
  4. Award: Contracts will be awarded to the most advantageous tenders, in accordance with Section 19 of the Procurement Act 2023.

This bespoke procedure is designed to balance full compliance with the Procurement Act 2023 with a streamlined, transparent, and fair process that secures the best outcomes for both Contracting Authorities and framework suppliers.
