Scope

Description

The Materials to be delivered under this Framework are to facilitate highway maintenance works to repair potholes and worn out carriageway carried out by Council's in-house operations teams.

Description of how multiple lots may be awarded:

The Council is seeking to award a maximum of 4 suppliers to each lot and Suppliers can bid for any lots that they are able to supply the materials for.

The Council reserves the right to not make an award at all.


Lot 1. Lot 1 - Bituminous materials

Description

The products are described as per BS EN 13108 & include Warm Asphalt Products complisant with Clause 908 (07/21) Warm Mix Asphalt (WMA) Specification for Highway Works.

Lot 2. Lot 2 - Ready Mix Concrete

Description

The products are described as per BS EN 206:2013 + A1:2016 (BS 8500 Parts 1 & 2 - Complementary British Standards to BS EN 206)

All constituent materials [e.g. Cement & Aggregates] are manufactured to a harmonised standard and under the Construction Products Regulations are required to be CE marked and have been tested at source in accordance to relevant standards, namely: -

• Cement - BS EN 197-1: Cement - Part 1: Composition, specification and conformity criteria for common cements

• Aggregates - BS EN 12620 - Aggregates for Concrete

• With guidance from BS8500 Part 2

Lot 4. Lot 4 - Miscellaneous Road Repair Products

Description

Data Sheets shall be provided for each of the products in the price list. The Data Sheets shall include the requirements for temperatures for storage and installation of the product. Recommended rates of spread shall also be provided.

For HAPAS and Non-HAPAS Certified Instant Road Repair Materials, full details of technical performance is required including current aggregate properties, initial type test certificates, cohesion information for bond coats, etc.

The use of Tack Coat has been superseded by the use of Bond Coat for all Cumberland Council works and supplies of Tack Coat are no longer required.

Rates to include all transport and handling charges associated with delivery, as well as all charges for collection of empty drums from various Depots located within the county of Cumberland

Framework operation description

If the Council decides to source the Materials through the framework, then it may order those Materials set out in Schedule 4 in accordance with the terms laid down in the Framework Agreement without reopening competition, as more particularly described below:

Orders without reopening competition for delivery of Materials

8.2 Authorised Officers shall:-

8.2.1 identify the relevant Lot(s) in which the Council's requirements fall into along with the relevant prices within the Pricing Schedule;

8.2.2 apply the Delivery Cost Calculation to the prices within the Pricing Schedule to determine the cost to the Council of using each Supplier within the Lot(s).

8.2.3 issue the Order to the Supplier, identified by the process outlined at 8.2.2 as providing the Materials at the lowest cost to the Council in accordance with clauses 8.4 to 8.10.

Orders without reopening competition for collection of Materials

8.3 Authorised Officers shall:-

8.3.1 identify the relevant Lot(s) in which the Council's requirements fall into along with the relevant prices within the Pricing Schedule;

8.3.2 apply the Collection Cost Calculation to the prices within the Pricing Schedule to determine the cost to the Council of using each Supplier within the Lot(s).

8.3.3 issue the Order to the Supplier, identified by the process outlined at 8.3.2 as providing the Materials at the lowest cost to the Council, in accordance with clauses 8.4 to 8.10

(ii) to make whatever changes it may see fit to the content and structure of the tendering competition; and in no circumstances will the contracting authority be liable for any costs incurred by the candidates. Any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of potential suppliers.

The contracting authority reserve the right to use any electronic portal during the life of the agreement.
