Description of risks to contract performance
This procurement is to secure a Supplier for energy on an initial 4 year contract term, being from 01 April 2027 until the 31 March 2031, with the provision to extend the contract term further by two separate, 2 year extensions, thus a possible contract term of 8 years from 01 April 2027 to 31 March 2035.
The Supplier will enter into a contract prior to the 01 April 2027 to enable it to mobilise to deliver the energy and services required under the contract. There will also be a requirement in the contract to demobilise and transition away from the Authority after the contract terminates to ensure the smooth transition away from its obligations to supply after the contract terminates.
The Authority is constantly reviewing its assets and its service providers and therefore the number of assets that will require energy will vary during the contract term. Some will be removed and others added on as the Authority acquires and disposes of assets, or as it decides to bring services in-house from existing service providers that previously occupied the Authority's assets under lease and were responsible for energy costs.
Equally, the Authority has several different programmes of investment to reduce energy demand and consumption, thus the volume of energy required is anticipated to fluctuate during the contract term also. The Supplier is expected and will be required to be flexible with the number of assets and meter points it is to manage as well as to fluctuating volumes of energy.

Justification for not publishing a preliminary market engagement notice
Justification for not publishing a preliminary market engagement notice. A preliminary market engagement notice was not published due to the specification of the requirement being already established and clear. Therefore, it was felt that no additional input from suppliers in the market to help with developing the requirement and approach to the procurement was required prior to publication of the tender notice. The supplier base is already known within the market and relatively static.
