National Highways is enacting this direct award under the Procurement Act 23 Section 41(6) Schedule 5 Section 5.

National highway requires a maintenance depot to cover the road maintenance of the A19 to prepare for the end of the Design Build Finance Operate (DBFO) contract ending February 2027. National highways carried out an extensive search for land in the area over the past 2 years to develop a new depot & office to meet this requirement. Land is very limited in the area, however a site became available towards the end of the search work around Jan 25, available only as a land sale and development option, ie. the developer will only sell National Highways this land if they carry out the development. This was the only site that meets the full requirements for the A19 maintenance, alternative solutions would not meet the requirements and pose reputational risk to both NH and DfT.

The planning and technical services are advance activities ahead of full Land Sale & Development agreement (subject to planning), that could not be carried out by any other supplier because the developer has control of that site.
