seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The Framework Agreement was initially for a value of £570,000.

This modification increases the overall value of the framework to £855,000 GBP and does not exceed 50% of the value of the original contract.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The authority published VEAT Notice 2024/S 000-039507 on 6 December 2024 which outlined the rationale regarding this modification which rendered it necessary. The modification has been made under Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled:

(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen;

Initial values were based upon historical spend however due to the ad hoc nature of this framework, and the increased incidents involving EA fleet, expenditure has been larger than previous projections. Modification to the framework is necessary to ensure ongoing service provision. The release of this additional spend for these services could not have been foreseen at time of tender and therefore not included in the original estimated Framework Agreement value. The framework is a demand led agreement, and the Authority could not have reasonably foreseen the increase on demand for these services. This service provision fluctuates significantly from month to month.

(ii) The modification does not alter the overall nature of the framework; and

(iii) Any increase in price does not exceed 50% of the value of the original contract or framework agreement. The awarded value of the original Framework Agreement was £570,000 GBP. This modification of £285,000 represents 50% of the original contract value.
