Explanation:

This contract is being awarded in compliance with the Utilities Contract Regulations 2016, specifically pursuant to Regulation 50 (1) (a) which states that:

"Utilities may use the negotiated procedure without prior call for competition in the following cases- (a) where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to a procedure with a prior call for competition, provided that the initial conditions of the contract are not substantially altered".

SE Trains previously issued a call for competition (FATS reference 2023/S 000-024274) but did not receive any suitable tenders, as detailed in the contract award notice (FATS reference 2024/S 000-036508).

SE Trains Limited can confirm that the conditions of the contract are not substantially altered from this prior call for competition
