To Provide Pharmacy Outpatient Dispensing Services:
On 19th August 2024, Lloyds Healthcare Pharmacy Services (LPHS) notified York and Scarborough Teaching Hospitals NHS Foundation Trust (the Trust) that they would be exiting the market for the provision of outpatient dispensing services by the end of December 2024 at the latest. LPHS informed the Trust that they had undertaken market engagement and were suggesting that this contract would be novated to Rowlands Pharmacy based on the existing terms of the contract.
The Trust sought both regional and national guidance on the issue.
Regional NHS Procurement Hubs were approached for advice as to how to manage this through existing national frameworks as it would not be possible to undertake a compliant open procurement process within the timescales set by LPHS. The Regional Procurement Hubs confirmed that there was no direct award process available under national frameworks and that there was not time to undertake a compliant further competition under national frameworks as suppliers on the framework require 12-16 weeks to prepare and complete any response.
National guidance has been issued to the Trust which is legally privileged.
Following a review of the national guidance, and the fact that it is not possible to conduct a procurement process in the timescales set out by LPHS, the Trust intends to novate the existing contract, on existing terms, to Rowlands Pharmacy.
The contract term is 28 Months .
