Direct award justification

Single supplier - technical reasons

This is a transparency notice to inform the market that Nexus is entering into a direct award with Harsco for the provision of a used rail grinding machine suitable for our specialist rail infrastructure. The specialist features on the machine Harsco can provide are not commercially available on used machines.

The timescales for design, manufacturing, testing and certification for an alternative used machine to be retrofit to Nexus requirements is not compatible with the deadline for the date the machine must be operational on site to allow the Tyne and Wear metro to address immediate rail defects and any arising rail defects that have the potential to be a safety risk if untreated.
