Extension of Fleet Management System "Tranman" contract for a period of 12 months using Regulation 72(1)(b).

The contract is currently used by 15 NHSS Boards with 3500 vehicles live. The system is a key tool in managing the fleet compliance and maintenance requirements with Boards needing to access and manage fleet data daily. If Boards cannot access the data there will be a risk of fleet non-compliance of legal requirements i.e. MOT, road tax, vehicle inspections. Further to this, Boards will not be able to report on fleet data.

However, the only formal remedy is to apply to the courts: An economic operator that suffers, or is at risk of suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 or the Procurement Reform (Scotland) Act 2014, may bring proceedings in the Sheriff Court or the Court of Session.

This extension is to allow a future procurement to be conducted prior to the contract end date (30/09/2025).

To provide for additional works, supplies or services by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor (Reg) 72 (1) (b).

(i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and

(ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority, provided that any increase in price does not exceed 50% of the initial contract value;
