CHIC publishes this Notice of an Amendment to be made to the DPS in pursuance of the original Notice 2018/S 189-427433 published in OJEU on the 28th September 2018 [and subsequent corrigendum Notice Reference: 2020/S- 600376] extending the DPS until 27th October 2028. All other details relating to this DPS remain unchanged.

CHIC invites organisations to participate in a DPS for agency and recruitment services for a further 60 month term with estimated value as detailed in this notice. The DPS will be accessible by members of CHIC. The DPS may be used by all Registered Providers of Social Housing, Local Authorities and all other contracting authorities that are located in the United Kingdom (“Customers”), including those listed in Schedule 1 of the Public Contracts Regulations 2015/102.

The DPS is also available to all current and future members of CHIC, a public sector consortium with a list of members available from: https://www.chicltd.co.uk/members

The estimated value of contracts to be awarded through the DPS during the 60 month period is approximately £80,000,000 excluding VAT. Any estimate of value is for information purposes only. Therefore, please note that there will be no form of exclusivity or volume that is guaranteed under the DPS and Members will be entitled to enter into other contracts and arrangements with other suppliers.

Individual contracts awarded following tender under the DPS will be subject to the Public Contracts Regulations 2015. Contracting authorities awarding contracts under the DPS are advised (but may choose not to) to incorporate a minimum 10 calendar day standstill period at the point information on the award of any contract award is communicated to tenderers. This period allows unsuccessful tenderers to challenge the decision to award the contract before it is executed/signed (as appropriate).

The Public Contracts Regulations 2015 (“Regulations”) provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly and within the time limits as defined in the above regulations. Where an agreement has not been entered into the court may order the setting aside of the award decision or order the Contracting Authority to amend any document and may award damages. If the contract has been entered into the court has the options to award damages and/or to shorten or order the contract ineffective.
