two.2.4) Description of the procurement

Enfield Council has four Leisure Centres (Albany Leisure Centre, Edmonton Leisure Centre, Southbury Leisure Centre, and Southgate Leisure Centre), along with Arnos Pool and Bramley Bowls Centre.

Since 2010 Fusion Lifestyle Ltd. has managed all six of the facilities under contract from the Council.

Fusion and Enfield Council have come to a mutual agreement to end the contract on 3rd December 2023.

The Council has made a decision to award a contract to Greenwich Leisure Limited (GLL, trading as Better) to operate the Council’s leisure centres. This contract will be for an initial period of three years, with an option to extend it for a further two years.

Section V2.1 - This is not yet concluded. The contract which the Council has made a decision to award will commence on 4 December 2023.

Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

The contract will be awarded through a negotiated procedure without prior publication pursuant to regulation 32 (2) (c) of the Public Contract Regulations 2015. This regulation allows the Council to award a contract without prior publication “insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures cannot be complied with”.

The urgency in this case results from the forthcoming end of the Council’s contract with Fusion on short notice, with the result that a full procurement cannot be undertaken at this time without a potential delay in continued provision of leisure services.

The Council is developing a longer-term strategy for the management of the leisure services and will be carrying out a procurement exercise to engage a permanent provider in due course. A market testing session will be arranged as part of the future procurement and will be advertised via Contracts Finder and Find a Tender Service for providers to express an interest.
