seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
To add the provision of separate food waste collection services to the Council's existing PFI contract from 31 October 2022 for the remainder of the contract period.
The initial contract term runs to 30th September 2030 with the option to extend for a further two years to 30th September 2032.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
The Council has recently completed a limited variation of its long-term PFI contract with the existing contractor, Veolia ES West Berkshire Limited, to enable the contractor to provide separate food waste collection services. The introduction of separate weekly food waste collections is a legal requirement under the Environment Act 2021. The existing PFI contract is integrated, meaning that the incumbent contractor is responsible for all aspects of the waste management chain including collection, recycling or disposal. It has not been considered feasible for the provision of the separate food waste service to be procured separately outside of the existing PFI contract for reasons of practicality, potential for significant delays and significant risks associated with integrating a new service provider onto the existing PFI contract specifically to deliver the food waste service. Furthermore, it is the Council's understanding that the completed contract variation to allow for separate food waste collections is allowable and lawful under current regulations.
