NHS Devon ICB (the Commissioner) was seeking providers who had the capability and capacity to deliver Level 2 and 3a NHS Orthodontic Services in North Devon and Torridge.
Orthodontics is the dental speciality concerned with facial growth, development of the dentition and occlusion, and the assessment, diagnosis, interception and treatment of malocclusions and facial irregularities.
The contract term will be for an initial period of 78 months and 24 days, with an option to extend for a further 36 months at the sole discretion of the Commissioner. Services are due to commence on 5th November 2025.
The total contract value excluding extensions is £3,584,551, and £5,222,734 including extensions.
The contract will be for the delivery of 6,635 Units of Orthodontic Activity (UOAs) per annum.
This notice serves as an intention to award a contract under the competitive process of the Provider Selection Regime (PSR).

two.2.4) Description of the procurement
NHS Devon ICB (the Commissioner) was seeking providers who had the capability and capacity to deliver Level 2 and 3a NHS Orthodontic Services in North Devon and Torridge.
Orthodontics is the dental specialty concerned with facial growth, development of the dentition and occlusion, and the assessment, diagnosis, interception and treatment of malocclusions and facial irregularities.
The overall aim of the service is to provide equitable, accessible, high quality and cost effective specialist orthodontic services, in line with the National Guide for Commissioning Orthodontics (2015).
Orthodontics is mainly provided for children and adolescents who meet the agreed criteria for NHS treatment and for adults where there is clinical justification and where prior approval has been agreed with the commissioner.
The contract includes the following services:
• Assessment and treatment delivered according to each patient's clinical needs, including interceptive treatment and in hours urgent care
• Treatment includes examination, taking of radiographs, diagnosis, preventative care, advice, planning of orthodontic treatment, supply and repair of orthodontic appliances including retainers for a period of 12 months following the completion of active orthodontic treatment
• Appropriate referral to other healthcare providers for mandatory or advanced mandatory services or any other appropriate and necessary healthcare
• Advice to the patient and other clinicians where appropriate
The contract is limited to orthodontic treatment within complexity Level 2 and 3a and excludes all mandatory services and the following additional services:
• Sedation services
• Domiciliary services
• Minor oral surgery
• Dental public health services
• Orthodontic complexity level 1 and 3b cases
The Commissioner will be contracting for the services using the standard clauses for a Personal Dental Services (PDS) Agreement.

The decision to award this contract in line with the Competitive Process was based on evaluation against the basic selection criteria (in the form of a Selection Questionnaire), which was assessed on a pass/fail basis, and the 5 key criteria, which were assessed through a combination of pass/fail questions, pass with clarification questions, and scored quality questions evaluated on a 0-4 scale, with the following weightings.
Several tender questions were asked under each of the key criteria.

The providers selected for award have been chosen as they passed the basic selection criteria and were the highest scoring bidder overall, against the key criteria.
After conducting a thorough Competitive Process, taking into account the key criteria and applying the basic selection criteria, NHS Devon ICB are content that the provider selected for award sufficiently met the key criteria and thus can proceed to contract award under the Health Care Services (Provider Selection Regime) Regulations 2023.
There was one potential declaration of conflict of interest made via the conflict of interest process and recorded accordingly. It was not deemed as an actual conflict or risk to the procurement, but was still managed accordingly with appropriate mitigations.
Award decisions have been recommended by the NHS Devon ICB PSR Steering Group, with key decision maker being the Acting Chief Operating Officer for NHS Devon ICB.
This is a Provider Selection Regime (PSR) intention to award notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The publication of this notice marks the start of the standstill period. Representations by providers must be made to the relevant authority by midnight on 11th June 2025. This contract has not yet formally been awarded; this notice serves as an intention to award a contract under the competitive process of the PSR.
