two.2.4) Description of the procurement
EM services are currently used to facilitate the curfew of a subject, the majority given either a Community Order, Court Bail Order or released on licence (collectively referred to as ‘Orders’). The execution of electronic monitoring and related services are governed by the provisions of the Criminal Justice and Court Services Act 2000, the Power of Criminal Courts (Sentencing) Act 2000, the Criminal Justice Act 2003 and the Criminal Justice and Immigration Act 2008.
MOJ are initiating this pre-market consultation prior to the anticipated competitive procurement for the provision of EM services across England and Wales, which currently has an expected Service Delivery Go Live date of January 2024. The intention of this pre-market engagement is to seek feedback and interest from suppliers across a range of aspects relating to the current and future service.
This includes, but is not limited to the provision of:
• Electronic monitoring platform(s) and application(s);
• Network provision, including mobile technology;
• Monitoring hardware supply and hardware support services;
• Monitoring operations;
• Field service operations;
• Potential service structure;
• Potential contracting arrangements.
The MoJ is keen to engage with a range of providers that have an interest in some or all different aspects of the overall service, as either a lead or subcontractor, ahead of finalising Service design and developing tender specifications and associated documentation.
Future Service Delivery of EM value and length are not set at this stage.

As set out above, the purpose of this Prior Information Notice (PIN) is to seek feedback and interest from suppliers across a range of aspects relating to the current and future service.
Supplier Engagement will be managed by the Authority utilising the MOJ e-sourcing portal (also known as Jaggaer); Ministry of Justice Sourcing Portal:
https://ministryofjusticecommercial.bravosolution.co.uk/web/login.html. Suppliers that are not already registered will need to register.
Interested suppliers can register their interest in the PIN, view the associated EM Supplier Briefing pack and are invited to complete a short questionnaire all via the MOJ e-sourcing suite- PQQs Open to all Suppliers -PQQ_268.
Please complete the questionnaire promptly as the next stage of the process is to seek further input from potential providers through market engagement events intended to commence in late November 2021.
Questionnaires are for Market Engagement only, responses to the questionnaire will not be evaluated against and is solely for the purpose of data capture.
Once the MoJ have gauged market interest, we will issue an invite to all interested parties, confirming the dates, timings and location of supplier forum(s)/event(s). Due to COVID these events are likely to be
conducted on Microsoft Teams.
Potential providers will not be prejudiced by any response to this PIN, or failure to respond. This PIN does not formally signify the beginning of a procurement and does not constitute a commitment by the MoJ to undertake any procurement exercise. The MoJ will reserve its rights as to the procurement route used. In the event that a suitable pre-existing framework is identified during market engagement the MoJ may decide not to issue a contract notice. Should a suitable framework not be identified and the MoJ decides to formally
commence the procurement for the EM Future Services in England and Wales, a separate notice will be issued through the Find a Tender service.
Any resulting procurement will be managed electronically via the MoJ e-sourcing suite.
