The approach to this tender is Light Touch under regulations 74 - 76 of the Public Contracts (Scotland) Regulations 2015. It is Open to any bidder.

All Advocates must be fully qualified

three.2.2) Contract performance conditions

It is a mandatory requirement of the contract that the provider is a full member of the Scottish Independent Advocacy Alliance (SIAA).

The service must be provided under the principals set out in the SIAA guidance.

Reference to the relevant law, regulation or administrative provision:

Principles and standards for independent advocacy were published by the Scottish Independent Advocacy Alliance in 2008 and updated 2019 and by the Scottish Government in its Guide for Commissioners in 2013. They underpin the service to be provided.

The legislation that underpins advocacy services includes:

- Mental Health (Care and Treatment) (Scotland) Act 2003

- Adults with Incapacity (Scotland) Act 2000

- Adult Support and Protection (Scotland) Act 2007

- Equalities Act 2010

- Human Rights Act 1998

- National Health & Social Care Standards 2017

- Social Care (Self-directed Support) (Scotland) Act 2013

- The Carers (Scotland) Act 2016.
