two.2.4) Description of the procurement at the time of conclusion of the contract:

Caerphilly County Borough Council ('the Council' established a Dynamic Purchasing System (‘DPS’) for the Provision of a Recycling and Haulage Service for Dry Mixed Recyclable (DMR) Waste Materials in June 2017.

Provision within the DPS documents was made to account for changes in legislation. In Wales new Workplace Recycling Regulations “Waste Separation Requirements (Wales) Regulations 2023” come into force 6th April 2024. This place a requirement for segregated trade waste and therefore this DPS has been modified to account for this change.

Provision of a trade recycling collection service for Caerphilly County Borough Council to adhere to the separate collections requirements of the new Waste Separation Requirements (Wales) Regulations 2023 (“Workplace Recycling Regulations”) that began in April 2024.

The contract is for a period of three (3) years with an option to extend for up to a further two (2) years to be reviewed annually or as otherwise agreed.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Welsh Government introduced the Waste Separation Requirements (Wales) Regulations 2023 (“Workplace Recycling Regulations”) beginning in April 2024, the Council had to reshape its services in order to adhere to these new Regulations. The services had originally been carried out in house. This is a new contract.
