The works/goods/services can be provided only by a particular tenderer for reasons that are:

The Remotely Piloted Aircraft Systems team, part of the UK Ministry of Defence (“MoD”), has awarded a Contract to General Atomics Aeronautical Systems Inc (“GA-ASI”) for the delivery of the Protector Training Conduct to train the initial 33 mission crews. The contract duration is for a period of 19 months from September 2022 until March 2024, with a value of $25.9M.

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 due to technical reasons.

This is because the Protector design, modifications, certification and training activities are based upon Certifiable Predator B (CPB) platform which GA-ASI are the designer and only manufacturer. This means GA-ASI are the only supplier with the required knowledge of the system and are the only supplier capable of providing and delivering the training needed on this contract.
