seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
A further 12 month extension to the contract, as a consequence of the COVID-19 pandemic and Delta variant causing the ongoing restrictions and impact in England, where a change of provider would have meant multiple engineer visits to each vulnerable service user, risking their health and welfare at this time.
The value of the proposed extension equals £54,000 (that is, 23.8% of the original call off contract's value).
An earlier modification of a 9 month extension was required in September 2020, as a consequence of the COVID-19 pandemic causing the ongoing restrictions and impact in England where a change of provider would have meant multiple engineer visits to each vulnerable service user, risking their health and welfare at this time. This extension did not alter the overall nature of the contract, the value of the extension equalled £42,000 (that is, 18.5% of the original call off contract's value).
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
In accordance with Regulation 72(1)(c) of the Public Contracts Regulations 2015, the need for the modification has been brought about by circumstances that a diligent contracting authority could not have foreseen, that is, as a consequence of the COVID-19 pandemic and Delta variant causing the ongoing restrictions and impact in England. A change of provider would have meant multiple engineer visits to each vulnerable service user, risking their health and welfare at this time. 12 months will allow for a safer mobilisation period over summer 2022 following a competitive tender process commencing shortly. Moreover the proposed extension will not alter the overall nature of the contract, nor will the increase in price resulting from it exceed 50% the value of the original call-off contract given that the value of the original call-off contract Under ESPO FRAMEWORK 203_15 FOR TELECARE AND TELEHEALTH PRODUCTS AND SERVICES equalled £227,000, whereas the value of the proposed extension equals £54,000 (that is, 23.8% of the original call off contract's value).
