The Office of the Police Ombudsman for NI (PONI) uses a bespoke case handling system to investigate the majority of its complaints and is the primary investigation system used within the office. PONI is placing this voluntary transparency notice to alert Economic Operators of its intention to award a contract to provide support and maintenance for its Case Handling System for 3 years (2 + 1 basis).

The application is based on proprietary software developed by the supplier that PONI is entitled to use under license agreement. PONI do not own the Intellectual Property Rights IPR for the system. In addition, the system provides an integration point for multiple components including third party licences/products that make up the overall application and therefore reliance is solely on the supplier for upgrade and recurring support and maintenance of the system.

Explanation:

The Client is relying on derogations 32(2)(b)(ii) and 32(2)(b)(iii) of the PCRs 2015 (as amended) due to the absence of a competitive supplier for technical reasons and because the current supplier owns the propriety rights for the system.
