Roads Service wishes to procure a Traffic Data Management System which will interface with all the traffic counting equipment currently in use. The system must be capable of reading data files from all traffic counting equipment currently in use and bespoke spreadsheet and text files from external survey companies (samples provided). Any office based IT equipment necessary to support the system will be provided by Roads Service and all data will be stored on a single central database located within the NICS network.

The initial contract period will be 3 years, with options to extend annually for a further 5 years. All necessary support and maintenance must be provided for the duration of the contract.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The original contract included an initial fixed period of 3 years with the options to extend annually for up to 5 years. Since the end of the initial period the contract has been annually extended to 29/9/19. A modification request was granted in 2019 for a further two year extension taking the contract to 29/09/21. This resulted in the contract value increasing from £610,000 to £662,400.

Work on a procurement exercise was due to commence during the duration of the first modification, however this was delayed due to the Covid- 19 pandemic and a shortage of resources within the department. Therefore a further two year modification is required to ensure continuity of service whilst a review and new procurement are progressed.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

This requirement (a 2nd two year extension) is a modification to the existing contract in accordance with Regulation 72 (1) (c) (i). This regulation allows for modification where the need has been brought about by circumstances which a diligent contracting authority could not have foreseen.
