Initially the contract was intended for the managed supply and delivery of building maintenance products required to improve and maintain the Council’s housing stock to the Welsh Government’s Welsh Housing Quality Standard (“WHQS”). The contract was then intended to develop to supply all reactive building maintenance products required during the stated period. The supplier was to act as supply partner to the Council and its nominated contractors for key components associated with all internal and external works for housing improvement and maintenance.

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Continuation for an additional 30 months of the Building Materials Supply Partner described above.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU).

1.The current high (and fluctuating) rate of inflation which makes it disadvantageous to the authority to re-procure at this time;

2.Ongoing fluctuations in the market price of building materials caused by shortage of supply of some materials; and

3.resourcing and other issues resulting from dealing with the Covid pandemic and its aftermath, the consequential effects of which have meant that, through focusing on other higher priority tasks, there is now insufficient time and resource to run a full re-procurement and manage a handover to a new contractor before the expiry of the contract term.
