This contract is for the provision of an Occupational Health Physician (OHP) services for both the City of London Corporation, a local authority, and the City of London Police Force.

COL require an experienced OHP 1 day per week for 45 weeks per year. The COLP require an experienced OHP for 1 day per week for 45 weeks plus 17 additional days. The additional days are to meet the Force requirement for recruitment and associated management meetings relating to recruitment and fitness to work procedure and advice.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

311410 - Occupational Therapy Services

The City (the Relevant Authority) is issuing this Modification Notice which is to be regarded as a VEAT Notice. At the present time, there is no equivalent to a VEAT Notice under the Health Care Services (Provider Selection Regime) 2023 (2023 Regulations) as there is under the Public Contracts Regulations 2015 (PCR 2015) .

This Modification Notice is intended to inform the market of the City’s intention to extend a Contract for the provision of an Occupational Health Physician service for the Relevant Authority in it’s capacity not only as a Local Authority, but also in it’s capacity as a Police Authority with the current provider, Kennedy Occupational Health. The initial period of the contract is due to expire on the 31st July 2024.

The Relevant Authority advertised the procurement of the Contract initially for 2 years with the possibility of review, and continuation for a further 2 years subject to satisfactory and effective service delivery. The Contract was procured under the Light Touch Regime of the PCR 2015. The service procured originally via the Light Touch Regime is now subject to the 2023 Regulations. There is an option to extend the current Contract with Kennedy Occupational Health beyond the 31stJuly 2024. The Relevant Authority has, in accordance with its own internal governance, sought approval to extend the Contract for a further two years with effect from the 1st August 2024 until the 31st July 2026. The service is a vital element of the Occupational Health Service and there cannot be any gap in this critical service provision. Any gap would be detrimental to the delivery of occupational health and safety advice to the organization, and would also impact upon the Relevant Authority complying with its statutory duties under the Health and Safety at Work Act 1974 and other relevant legislation.

Whist the two year extension was within the permitted scope of the original procurement, in accordance with the transitional provisions set out in the 2023 Regulations, any modifications of the Contract will now be subject to the 2023 Regulations.

The total value of the Contract including the extension will now exceed the £500,000 threshold criteria set out in Regulation 13 ( 2) (b) (i) of the 2023 Regulations . The value pertaining to this Modification Notice is £382,880 increasing the contract value to £645,345.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

The Contract is performing well, and the extension has been built in the contract, which is performing well from a commercial perspective. Replacing such sole supplier with an in-depth knowledge of the service provision and the Corporation and Policing (a complex area for OH) would be worse commercially than extending the contract by two years avoiding procurement costs, and issues with onboarding, especially should the provider be changed.
