seven.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
33 The provisions of Regulation 72 (1)(b) permit a modification to an existing contract without a new procurement procedure where all of the following conditions are fulfilled:
(b) for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor:
(i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and
(ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority, provided that any increase in price does not exceed 50% of the value of the original contract.
It is considered the above conditions are met because:
• the suggested service model that has been developed during the service review represents a significant change. It is therefore considered necessary to consult with relevant stakeholders before going out to procurement in order to ensure that this is the best course of action to meet the needs of the residents of Leeds. There is not sufficient time remaining in the current contracts to include this phase, and therefore an additional three-month period of service delivery is required to ensure continuity of provision for service users;
• given the short timescale of the additional activity, there would be significant costs associated with procuring an interim service, nor would it stimulate interest from the market for a low value service; and
• the percentage uplift of 5% is within the range permitted under the Regulation.
seven.2.3) Increase in price
Updated total contract value before the modifications (taking into account possible earlier contract modifications, price adaptions and average inflation)
Value excluding VAT: £1,469,871.06
Total contract value after the modifications
Value excluding VAT: £1,543,364.56
