two.1.4) Short description
The Ministry of Justice (MoJ) are preparing to initiate a procurement process for the future provision of services for Electronic Monitoring (EM) across England and Wales. To note some provision requires limited services in Northern Ireland and Scotland as appropriate.
EM services are currently used to facilitate the curfew of a subject, the majority given either a Community Order, Court Bail Order or released on licence (collectively referred to as ‘Orders’). The execution of electronic monitoring and related services are governed by the provisions of the Criminal Justice and Court Services Act 2000, the Power of Criminal Courts (Sentencing) Act 2000, the Criminal Justice Act 2003 and the Criminal Justice and Immigration Act 2008.
The future EM service will be delivered under two distinct contracts:
Monitoring Device Systems Service (MDSS) - A service delivered under one national contract for all monitoring devices and supporting systems.
Field and Monitoring Service (FMS) - A service delivered under one national contract for field and monitoring services. The MoJ will run two distinct and separate procurements for MDSS and FMS with each procurement resulting in the award of a single national contract.
This PIN relates to MDSS only.
MDSS includes packaging various monitoring device related functions together, which will include:
the provision of all monitoring devices (location monitoring, radio frequency, alcohol monitoring and non-fitted devices) based on demand; and
the systems and functions underpinning the delivery of the devices, including mobile network provision.

two.2.4) Description of the procurement
As set out above, the purpose of this PIN is to inform the market of the upcoming MDSS procurement.
This is a critical service for the MoJ requiring the development of a strategic partnership with the MoJ as the primary device supplier to support the development of the device market, drive product innovation, change and the delivery of continuous improvement in product delivery.
The MoJ requires the MDSS supplier to have the following key specific capabilities:
Application Development and Operation including incident resolution and release management
Device Supply (Tags and Mobile Phones) including configuration, investigating device tampering, failure root cause identification and repair
Mobile Network Provision
Server and Network Supply and Support
The supplier will be required to ensure the continuous supply of all required monitoring devices and systems to support existing and future EM users.
The current EM service provides for the tagging of around 15k individuals a year but the MoJ plans to increase the number of individuals tagged during the contract term.
At the start of the contract the supplier must be able to deliver the following devices and systems, either directly itself or through one or more sub-contractors:

The MoJ may, during the contract term, add to or amend the scope of EM in accordance with ministerial ambitions and their longer-term strategy. Therefore, suppliers should note that any numbers, volumes or values expressed in this PIN are indicative only and might be subject to change during the contract term.
Although the MoJ is the contracting authority for the procurement of MDSS and will be the contracting counterparty for MDSS, it intends to allow other government departments and arms-length bodies to have access to MDSS via its contract as service recipients who may add further to the volume of tags and service required.
The dates below set out the anticipated timeline for MDSS. The MoJ will act reasonably at all stages but reserves the right to change the timing as appropriate.
1st Aug 2022: Publication of Contract Notice, Selection Questionnaire (SQ) and Invitation to Participate in Dialogue.
1st Sep 2022: Deadline for responses to the SQ to be submitted.
14th Sep 2022: Deadline for initial tenders to be submitted.
17th Oct – 12th Dec 2022: Competitive Dialogue period.
19th Dec 2022: Bidders invited to submit their final tenders.
1st Feb 2023: Deadline for final tenders to be submitted.
Feb – May 2023: Preferred bidder identified and testing of devices.(approximately 6 weeks).
by July 2023: Contract Award.
July 2023 – Jan 2024: Mobilisation before go-live on February 1st, 2024.
The integration, collaboration and delivery of MDSS and FMS together as a single service is critical to the successful delivery of EM, so the procurements will be run broadly alongside each other and lead to aligned implementation and go-live of the new EM service.
Suppliers who bid for MDSS may also bid for FMS and, subject to the MoJ’s requirements in each procurement process, the same supplier may be awarded the contracts for both MDSS and FMS.
Supplier engagement will be managed by the MoJ utilising its e-sourcing portal (known as Jaggaer); Ministry of Justice Sourcing Portal (bravosolution.co.uk) Suppliers that are not already registered on Jaggaer will need to register.
This PIN does not formally signify the beginning of a procurement and does not constitute a commitment by the MoJ to undertake any procurement exercise. The MoJ reserves its rights as to the procurement route used and may not issue a contract notice or complete the procurement in the way described above.
