Description
Durham County Council requires a competent and accredited Contractor to deliver a comprehensive programme of Legionella Risk Assessments across approximately 525 premises, including but not limited to offices, public buildings, educational establishments, leisure facilities, communal areas, fire stations and sports pavilions.

Framework operation description
Prices are determined based on the tendered rates.
Following this procurement exercise, the bidder who achieves the highest weighted score will be awarded a contract as the Framework provider.
All 'call-off' contracts will be based on the Terms and Conditions detailed in the procurement documents and the tender response submitted by the successful Bidder during the formal procurement process.

This Framework will be available for use by Durham County Council and the following additional Contracting Authorities, where they have entered into a Procurement Service Level Agreement (SLA) with Durham County Council:
- Academy Schools and Multi-Academy Trusts in the North East
- Maintained Schools in County Durham
- County Durham and Darlington Fire and Rescue Service,
- Believe Housing
- Parish Councils and Town Councils in County Durham.
The above list is not exhaustive, however, and in addition to the above the Framework may also be made available to other Organisations and Local Authorities where agreed with Durham County Council.
In the event that any one of the partners wishes to use the opportunity they will required to enter into an access agreement, which will regulated their use of the framework agreement.

Participation
Legal and financial capacity conditions of participation
As stated in the procurement documents:
The bidding organisation must confirm that at the date of their Bid submission, having regard to financial performance, their financial standing is of sufficient strength to allow them to fulfil their obligations and operate as a going concern under the Framework.
The bidding organisation must confirm that it has or, if successfully awarded a contract, will commit to obtain, the levels of insurance cover indicated below:
Employer's Liability Insurance = £5million
Public Liability Insurance = £5million
Professional Indemnity Insurance = £1million
Motor Vehicle Insurance - third party cover required as a minimum
The bidding organisation must confirm understanding and obligations with H&S legislation and compliance with requirements.
The bidding organisation must confirm that it has not been convicted of breaching environmental legislation, or had any notice served upon it, in the last three years by any environmental regulator or authority (including local authority), and confirm it has processes in place to check whether any subcontractors (where relevant) have been convicted or had a notice served upon them for infringement of environmental legislation.
The bidding organisation must confirm that it complies with all of its legal obligations in relation to Equality and Diversity Legislation.
