seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

This modification is permitted under the Health Care Services (Provider Selection Regime) Regulations 2023 as it is in response to external factors beyond the control of the council and the provider i.e. the national NHS pay award, plus the contract stipulates that "The impact on the Service of future NHS pay awards will be considered by the Commissioner in conjunction with the Provider in order to agree a mutually acceptable resolution."

A. A one-off payment during 2024/25 of £87,513 to cover the recurrent impact of the 2022/23 and 2023/24 NHS pay awards on the Service during April to September 2024. The impact of these previous pay awards was built into the budget for the new contract, however, as this contract commenced mid-year on 1 October 2024, an additional payment is needed to cover April to September 2024.

B. A recurrent uplift of £145,247 to the annual contract value due to the 2024/25 NHS pay award and net tariff inflator increase.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

A. A one-off payment during 2024/25 of £87,513 to cover the recurrent impact of the 2022/23 and 2023/24 NHS pay awards on the Service during April to September 2024. The impact of these previous pay awards was built into the budget for the new contract, however, as this contract commenced mid-year on 1 October 2024, an additional payment is needed to cover April to September 2024.
