The authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers.

This period allows unsuccessful tenderers to seek further debriefing from the authority before a contract is entered into applicants have 2 working days from the notification of the award decision to request. Additional debriefing and that information have to be provided within a minimum of 3 working days before the expiry of the standstill period. Such additional information should be sought from the contact named in this notice.

If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts Regulations 2015 (SI 2015 No. 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).

seven.2.1) Description of the modifications

Price cap added, subject to Employer’s risks materialising after 1st October 2022.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

On the first condition, the reasoning is that this is an experimental project, which explains the unforeseen circumstance (significant cost overruns due to the experimental nature of the project) and that is the principal purpose of a Target Cost Contract. This certainty obtained through the price cap would not have been possible initially, due to the aggregate risks inherent to the experimental nature of the project. On the second condition, adding a cap does not alter the overall nature of the contract, as the contractor is still providing services in relation to the design and procurement, manufacture, delivery, installation and commissioning of CHIMERA. On the third condition, the reasoning is that adding a price cap does not carry any increase in price.
