The Contracting Authority does not intend to include a sub-contract clause as part of community benefits (as per Section 25 of the Procurement Reform (Scotland) Act 2014) in this contract for the following reason:

Project start date is time critical and tendering contractors are expected to enter into agreement with any required sub-contractors during the main works tender period. There is insufficient time available for a separate sub-contract tender process after award of this contract.

The Contracting Authority does not intend to include any community benefit requirements in this contract for the following reason:

Ullapool Harbour Trustees are not a Public Sector Contracting Authority in terms of the Procurement Reform (Scotland) Act 2014 and compulsory Community Benefit requirements do not therefore apply to this contract. However, voluntary Community Benefit offers, by bidders, will be considered in the scoring of submissions.
