Description

YPO are looking for Suppliers to be appointed onto a Framework Agreement following a Competitive Tendering Procedure for the supply of Stairlifts & Associated Services to the public sector. This Framework is designed to meet the needs of YPO and Other Contracting Authorities by establishing an agreement where the end customer will place the order with the Supplier and the Supplier delivered direct to the end customer.

Framework operation description

Lot 1 to Lot 7.6 will have a call-off route as an Award Without Competition or a Competitive Selection Process.

Lot 8 will be a Competitive Selection Process only.

Award without Competition Lot 1 to Lot 6

The customer will conduct a Desktop Analysis based on: -

- Region of supply

- Lot Required to meet customer requirements

- Cost Criteria

- Total Cost of Ownership (TCO)

Award without Competition Lot 7.1 to 7.6

The customer will conduct a Desktop Analysis based on: -

- Region of supply

- Sub-Lot Required to meet customer requirements

- Cost Criteria

- Total Cost of Service and Maintenance

The relevant Lot Pricing Schedule(s) should showcase the products and services as relevant which the Supplier can provide under the scope of each Lot with pricing and relevant information, to be available to Contracting Authorities to buy using an Award without Competition mechanism.

If the customer calling off the framework cannot identify best value for money, based on the above criteria, or because their requirements are bespoke, or the customer wishes to re-open competition then a Competitive Selection Process should be carried out.

Competitive selection process

- Contracting Authorities will be allowed to stipulate Conditions of Participation and Mandatory Requirements to refine those set out for framework assessment and define them specific to their Call Off requirement. These conditions and requirements must be a proportionate means of ensuring that Suppliers who are invited to compete have the legal, financial, technical and professional capacity and ability to perform the Call-off Contract. The customer may require Suppliers to provide evidence in order to verify whether a particular condition of participation or requirement is satisfied, e.g. relevant accreditations. If the Supplier is unable to satisfy the customers Conditions of Participation and/or Mandatory Requirements, they may be excluded from the Competitive Selection Process.

- Suppliers will be required to submit "sealed bids" via the customer's choice of e-tendering site in response to the customer's tender. The Award Criteria for such competitions are specified below. Each time the customer runs a Competitive Selection Process; the award decision will be based on the below criteria:

Conditions of Participation: Customers will be allowed to include conditions of participation and Mandatory Requirements to refine those set for framework establishment.

Cost: Permitted range 10%-80%. Customers will have the option to amend weightings at the Competitive Selection stage to suit their internal needs/policies. Re-opening this criterion is mandatory.

Quality (includes Delivery and Customer Service) : Permitted range 10%-80%. Customers will have the option to amend weightings at the Competitive Selection stage to suit their internal needs/policies. Customers may reopen this criterion in full, or scores may be carried through from the Framework Establishment stage.

Social Value and Sustainability: Permitted range 10%-30%. Customers will have the option to amend weightings at the Competitive Selection stage to suit their internal needs/policies. Customers may reopen this criterion in full, or scores may be carried through from the Framework Establishment stage.

Where Contracting Authorities flex the Award Criteria to suit their individual requirements then the overall Award Criteria must total 100%.

It is intended that each time a Contracting Authority runs a Competitive Selection Process, the award decision will be based on the above criteria.

Customers at their own risk may flex the recommended Competitive Selection Process weightings within the permitted ranges specified above, depending on whether the customer requirement is Cost, Quality or Social value driven.

YPO recommend that at least 2 award criteria is re-opened if a Contracting Authority wish to flex the Award Criteria at Competitive Selection Process stage

Contracting Authorities will apply a scoring scale of their own choosing to evaluate responses to the above criteria. The exact scoring scale will be determined at the Call-off Competitive Selection Process stage and made clear within those documents.

It is intended that most Call-off competitions under this Framework will be conducted using a one stage process as described above, however Contracting Authorities have the option to incorporate one or more of the following elements into their one stage Competitive Selection Process:

 Reverse electronic auctions;

 Site visits;

 Conditions of Participation and/or Mandatory Requirements;

 Samples evaluation

 Product demonstrations;

The exact Competitive Selection Process procedure will be described by the Contracting Authority in the Call-off competition documents.

For Competitive Selection Process Call-offs, a mechanism for determining price payable will be as follows:

- Contracting Authorities will provide Pricing Schedule at the Competitive Selection Process stage, which all participating Suppliers will be required to complete and return as part of the "sealed bid" process.

- Contracting Authorities may, at its sole discretion, evaluate pricing under a Competitive Selection Process using such approach as it deems appropriate, which may include but is not limited to the following:

- by reference to predicted annual volumes/predicted annual usage;

- total number of sites for which the Competitive Selection Process is being carried out;

- evaluation on a bulk basis where Suppliers must bid for all lines to be considered; and/or

- evaluation on a line by line basis where Suppliers may bid for any lines.

Other information

Description of risks to contract performance

YPO has identified the following potential Contract risk affecting this Framework:

In the event that a significant event outside the reasonable control of the Supplier occurs which has a material impact on the volatility of the market to such an extent that it becomes unsustainable for Suppliers to maintain the current fixed pricing offered, the Parties may enter into good faith negotiations during the fixed period to renegotiate the fixed pricing to reflect the current pricing. Any agreement to a variation to the fixed pricing by YPO will be in writing and conditional on the following:

• The Supplier taking all reasonable steps to mitigate the impact of such event on the fixed pricing offered under the Framework;

• The provision of satisfactory supporting evidence to YPO to justify any increases in costs to YPO and/or any OCAs; and

• That the proposed modification is at all times compliant with the provisions of the Act.
