Scope

Description

Provision of maintenance and licensing services to the newly fitted Automatic Passenger Counting (APC) equipment on XC's Turbostar and Voyager Fleets.

Single supplier - technical reasons

The rolling stock operated by XC Trains is owned by the respective Rolling Stock Companies (ROSCOs), who hold contractual rights to nominate and mandate the suppliers used for work on their assets. For this requirement, the ROSCO has specified the supplier that must be used.

Because the ROSCO retains ownership and technical authority over the fleet, we are not able to select an alternative provider or run a competitive process. Appointing any other supplier would breach existing lease and maintenance agreements, risk incompatibility with proprietary systems, compromise safety obligations, and potentially invalidate warranties.

There are no viable alternatives due to the technical, contractual, and safety constraints linked to the ROSCO‑controlled rolling stock. Only the supplier mandated by the ROSCO can legally and safely carry out the required work.

A direct award is therefore justified on the basis as per the procurement act 2023 under section 43 - paragraph 7 incompatibility therefore competition is not possible and a single‑supplier situation exists due to contractual and technical exclusivity.
