seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The contract "Transcription Services for Public Inquiries - the Sheku Bayoh Public Inquiry" (CASE 563486) has been modified under Regulation 72(1)(b) of the 2015 Regulations. The modification has extended the contract for the period 1 April 2024-31 March 2025 and increased the maximum contract value by a maximum of GBP 192, 000 (excl. VAT). This contract was established as Lot 2 of "Transcription Services for Public Inquiries ( 2 Lots)" (CASE 559302).

For clarity, the full duration of the contract after this modification is 36 months and its total maximum value is GBP 589,500 (excl. VAT).

seven.2.2) Reasons for modification

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Additional works had become necessary to support the activities of the Sheku Bayoh Public Inquiry and complete the hearing phase of the Inquiry. A change of contractor would have seriously jeopardised the remaining hearing schedule of the Inquiry. The existing contractor is fully integrated with the separate broadcasting contractor to deliver the public hearings, meeting the accessibility obligation on the Inquiry. There are virtual private networks set up and operational allowing the stenographer stable and reliable access to the live hearing, and back-up arrangements are in place. Changing contractor at this point would have potentially resulted in the loss of over two years of legal analysis needed to conclude the evidential hearings. Even if a like for like system was available, resource and cost of training users and implementation would have likely delayed the planned hearing schedule, and the overall duration and cost implications would have been significant.
