Oldham Council as the Contracting Authority in partnership with Procure Partnerships intends to let a North West Contractor Framework with a maximum duration of four years, which may be used to award contracts for Oldham Council's pipeline of works and will be accessible by North West public sector bodies / 'Contracting Authorities' as defined by the Public Contracts Regulations 2015. Procure Partnerships have successfully been operating and delivering a North West Contractor Framework across the North West of England for the past three years supporting with the procurement and delivery of over 100 construction projects within this period. The Framework is designed to align with the ambitions of the Construction Playbook, and to help the public sector deliver on the Government's ambition to 'build back better' bringing together commercial best practice and reform to drive better, faster, greener delivery.

A Framework go-live date of 1st April 2022 is planned. Please refer to the procurement documents for a breakdown of the procurement timetable. The Framework is therefore anticipated to expire in March 2026 but in line with the Public Contracts Regulations 2015 Framework users may award contracts under the Framework which may exceed the length of the Framework itself.

Potential Framework users may include North West; Schools, Academies, Colleges, Universities, Blue Light/Emergency Services, NHS Bodies, Local Authorities, Health and Social Care Bodies, Housing Associations, Libraries and Museums, Registered Charities, Government Departments, Leisure Providers, Clinical Commissioning Groups; as more particularly set out in Additional Information (Section 5) below.

Users of the Framework will be able to procure works with associated services (e.g., new build, refurbishment, fit out, infrastructure, single site/project works or multi site projects/ programmes of works) thereunder on the basis of established fixed Contractor overhead and profit rates, and hourly rates. Projects may be of Design and Build or Build Only in nature, under a Two Stage or Single Stage procurement route, embracing both NEC and JCT forms of contract, in compliance with the restrictions on and full freedoms for the range of works and building types provided by the CPV codes referenced. CPV codes 71000000 and 44000000 are to be taken as being covered by this procurement only in context of delivering 4500000 construction works. As well as helping to facilitate collaboration and innovation to deliver projects that will meet the changing needs of our built environment and support ambitions to build back better, the Framework will be structured to enable the delivery of meaningful Social Value, benefitting our communities, our environment and helping to protect the future of the industry.

As a reflection of the government's policy drive to use public procurement as a vehicle through which to foster social and economic development, many public sector bodies (Oldham Council and other potential Framework users) are required or choose to evaluate Social Value in their procurements covered by the Public Contracts Regulations 2015, (wherever it is reasonable and proportionate to do so) to address key themes of Covid 19 recovery, tackling economic inequality, equal opportunity, fighting climate change, and wellbeing, by attaching certain desirable goals within those themes that a public contract might be evaluated upon.

As a Co-operative Council, Oldham is committed to acting in a socially responsible way and to influencing others with whom we work with to do the same. It is increasingly important for public sector bodies to secure the maximum possible value from every pound of public money spent. This means taking into account the cost of each contract, but it also encompasses a broader evaluation of the value of each contract - including the wider social, economic and environmental outcomes each contract can deliver. To this end Social Value is a Framework award criterion worth 10% of the total marks available under this procurement process. Bidders are not required to access any specific social value third-party platform or system in order to submit a response to this opportunity. However, once the Framework is awarded, Social Value may also be used by Framework users as a Call-Off criterion as they consider relevant to their own particular requirements and organisational objectives. At Call-Off stage Framework users may require Contractors to engage with a specific Social Value third-party platform or system (such as the Social Value Portal) in order to submit a response to their mini-competition or direct award.

Additionally any organisation or corporation within the North West not having an industrial or commercial character, will be able to use the Framework if they are financed wholly or mainly by another Contracting Authority referenced herein, or subject to management supervision by another Contracting Authority referenced herein, or where more than half of the board of directors or members of which, or, in the case of a group of individuals, more than half of those individuals, are appointed by another Contracting Authority, or an association of or formed by one or more of the Contracting Authorities referenced herein.

Any indicative Framework value provided is a forecast estimate informed by historical data and anticipated future demand. The total value of projects which may be procured under the proposed Framework cannot be guaranteed and should not be relied upon by interested parties in making their commercial decisions associated with this procurement opportunity.

The Contracting Authority reserves the right to discontinue the procurement process it commences and not to award any contract(s). It also reserves the right at its absolute discretion to amend the information stated in this notice at any time.

To cover the legal and administrative costs of procuring and setting up the Framework each successful Tenderer/Contractor offered a place on a Framework Lot will be charged a one-time subscription fee should they wish to accept their place.
