Explanation:
Medway Council procured the initial Rochester Airport works and subsequently awarded a contract to Kier for the sum of £4.3m.
Further works were required for an additional contract sum of £2.6 million and therefore the value of this contract is now in excess of the financial threshold and the Public Contract Regulation 2015 (PCR 2015 ) are applicable.
The proposed extension and increase in contract price does not contravene the PCR 2015 which in accordance with Reg 72 (1 ) (e) permits modifications of contracts irrespective of their value provided that the modification is not substantial within the meaning of Reg 72 (8 ).
These additional works are ancillary to the original works and does not constitute a substantial modification because the works do not :
a) extend the scope of the works considerably or;
b) render the contract materially different in character or;
c) change the economic balance of the contract in favour of the contractor in manner not provided for in the initial contract or introduce conditions permitting the admission of candidates or acceptance of tenders or attracting additional participants
