BITMO (Belle Isle Tenant Management Organisation) require the re-procurement

of Gas Servicing, repairs and maintenance works plus new installations to 1,940

Council housing stock within the BITMO responsibility. The current contract is

due to expire at end September 2014 and includes for Gas Servicing, repairs and

maintenance work. It is also to include for responsive maintenance, gas

service and safety checks to all mechanical activities to include natural gas,

renewable energy appliances, replacement and installation of central heating

systems.

Explanation:

Leeds City Council procured a below threshold contract in April 2015 which is due to expire in March 2022. However, in order to align services with LCC the BITMO team wishes to vary the contract end date to March 2024 so that these works/services can be procured in conjunction with LCC. Varying the end date means that the contract will breach the relevant works threshold by an estimated £550,000.00 so we are publishing this notice on a voluntary basis to be as open and transparent as possible. It is anticipated that the new procurement exercise will be advertised on or around Spring 2023.

If an appeal regarding the award of a contract has not been successfully resolved the (for Public Sector)Public Contracts Regulations 2015 (SI 2015 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and NorthernIreland). Any such action must be brought promptly (generally within 30 days beginning with the date when the potential contractor first knew or ought to have known that the grounds for starting the proceedings had arisen). Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages. Following the 10 day standstill period, if no further debriefing has been requested, the court may only award damages once the contract has been entered into.
