four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The project in question involves the development of an unused (8.8 acre) area of land on DP World London Gateway Port (LG Port) into a multi-functional truck parking facility in order to provide suitable transfer of European documentation (TADs) preparation and handover to drivers and other administrative legal processes that will be required for trucks and drivers following Brexit. This facility will also act as a holding area for HGVs waiting clearance to enter / leave the new Border Control Post being constructed at LG Port as well as providing an amenity area for HGV drivers (New Project). The cost of the New Project will be approximately £8 – 9 million, of which £6 million will be funded by the Government under the Port Infrastructure Fund (PI Funding). LG Port applied for PI Funding in October 2020 and that it was announced in late December 2020 that the application had been successful.

At the point that London Gateway Port Limited (LGPL) was notified that it had been successful in obtaining the PFI funding, it had not received the Grant Funding Agreement (GFA) from the Secretary of State yet. The GFA was received on 8 January 2021 and completed on 8 March 2021. The GFA requires the LGPL ensure “…that the Funded Activities will be available for use by the Authority and other Crown Bodies for the provision of Border Control Services as soon as possible and before 01 July 2021”. This left LGPL with very little time to procure a suitable contractor, negotiating the construction contract and deliver the New Project by 1 July 2021.

Given the programme for delivery, the latest date on which the construction contract could be signed in order to meet the 1 July 2021 deadline was end of February 2021. It was also critical to deliver New Project as quickly as possible given the complexities in the UK import and export market created by a combination of Brexit and the global pandemic in order to minimize disruption for importers and exporters (including essential goods, PPE Etc.). On that basis LGPL had to opt for the extreme urgency procedure as the accelerated procedure would not have been fast enough to allow the delivery of the New Project on time.
