Section six. Complementary information

six.3) Additional information

The services required under this contract is for a full funeral service including; removal of the body to an appropriate facility, making arrangements for a funeral service, preparation of the body and the provision of the coffin. The funeral service provided should be capable of meeting the needs of the diverse community for which the Council is responsible.

The Council has a legal obligation to meet its respective responsibilities under the 2014 Care Act and 1984

Public Health (Control of Diseases) Act. The Act requires that deceased persons without family or friends able or willing to make arrangements for their burial, should have the necessary arrangements made by the local authority.

Deaths which occur where there are no known relatives are allocated to a social care worker. Should the Council locate a relative it will ask them if they wish to take over the funeral arrangements and/or the payment for the fun. It is expected that there will be around 100 funeral services required annually under the contract, with the majority of these being cremations.

The authority will incorporate a minimum 10 calendar day standstill period at the point information on the modification of the contract is communicated . This period allows interested parties to seek further information from the contracting authority before the modification is entered into.

Such additional information should be requested from the addressee found in I.1. If an appeal regarding the modification of a contract has not been successfully resolved the Public Contracts Regulations 2015 (SI 2015 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (within 30 days beginning with the date when the economic operator first knew or ought to have known that grounds for such action had arisen).

The end date of the contract will be modified by two and a half years from 1.04.2025 to 30.09.2027.

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

A change in contract would cause inconvenience and disruption to current service levels. A market sounding exercise conducted prior to this modification revealed there was no interest from the market.
