seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The current contract is to be extended by a 2 year period, the cost of the extension is 10 379 000.00 GBP.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
At the end of January 2020 the previous contract term with Continental Landscapes Ltd under Public Contracts Regulations 2015 72 (1) (b) was extended for a three-year period until this 31st December 2024. When this decision was taken it was the intention of the Council to examine the scope of works that could be included in any future arrangement. This would have provided a timeframe to explore options to expand the scope of works, improve the seasonal balance and reduce the need for temporary staff. This would have had the added benefit of potentially aligning other existing arrangements to provide a more efficient and effective service.
Immediately after this decision was made, in February 2020 the key officers involved were tasked with preparing for the Covid-19 pandemic response and in particular to review relevant
business continuity arrangements. The impact on capacity to undertake the planned review has continued until the recently implemented end to national restrictions and therefore the
benefits of the extension secured in January 2020 have not been realised.
Given this two-year hiatus that could not have been foreseen, there is an option to further vary the existing contract by extending the term for a two-year period from the end of the existing contract until 31st December 2026.
