Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Modification Notice for extension of contract with Tivoli Services. This is a 6 month extension to an existing contract (685733). A full procurement exercise will be undertaken for a new 3-year contract during the course of the next few months. Prior Information Notice has been released - document number on PCS is 685309.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Clyde Valley Group entered into discussions with Scottish Procurement Alliance in October 2021 to award a number of contracts through their framework agreements. During the process of awarding a contract for the provision of landscaping services, SPA were unable to find a suitable supplier, with none of the companies on the framework being willing or able to take on the contract. This became apparent to CVG in February 2022. CVG took legal advice and, in order to maintain services to customers, entered into discussions with the incumbent contractor around an extension under the unforeseen circumstances exception (2015 Regs – Regulation 72(1)(c)). This is a 6 month extension to cover the spring and summer growing periods. A full procurement exercise will be undertaken for a new 3-year contract during the course of the next few months.
