The Direct Payment Support Service (DPSS) provides information and advice to people who receive a Direct Payment from the Council or fund their own care and support. The service helps people to find, recruit and pay for the types of care and support they wish to receive. This enables people with care needs to have greater choice and control over the care they receive.
The DPSS contract in Peterborough was awarded to Peterborough Council for Voluntary Service (PCVS) in December 2017 following a tender process held according to PCC procurement rules. The contract commenced on 1st March 2018 for 3 years with 2 possible extensions of 12 months.
The Council is required to ensure that it provides care in accordance with the Care Act 2014 as supported by the existing contract, which expires on 28th February 2023. The further extension is for 24 months, to be extended in blocks of 12 months

seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
Extension of contract for a maximum 24 months (ie 2 extensions, in blocks of 12 months)- period from 01/03/2023 - 28/02/2025, so that the total contract period is 01/03/2018 - 28/02/2025. The original contract value was below threshold at the time of award however, the extended contract in consequence of this modification now places the contract value above threshold.
The modification has been considered in accordance with Regulation 72(1) (c ) of the Public Contract Regulations 2015, which states that modifications can be made where all of the following conditions are fulfilled:
(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen;
(ii) the modification does not alter the overall nature of the contract;
(iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
A plan to recommission the DPSS was approved with a planned Invitation to Tender (ITT) issue date of 9th September 2022. This timescale assumed that resources would remain static however, these were depleted to the extent that there is no capacity within the service area to retender the service and so an extension to the current contract is necessary to maintain service provision. It is proposed to extend the service with the current provider for 24 months on a 1+1year basis (01/03/2023-28/02/2025) thereby increasing the total contract term to 01/03/2017 - 28/02/2025. This allows sufficient time for a planned increase in resources to support the new procurement process.
The Council is required to ensure that it provides care in accordance with the Care Act 2014 as supported by the existing contract, which expires on 28th February 2023. Unless the Council extends the existing contract, the Council will not have a contract in place to deliver the essential services and meet its obligation under the Care Act.
The modification has been considered in accordance with Regulation 72(1)(c ) of the Public Contract Regulations 2015
