Broadacres is seeking to award a grounds maintenance contract (“Contract”) across their area of operation to a single contractor. Schedule of sites requiring grounds maintenance under the contract is over 200 locations throughout North Yorkshire. Contract duration will be approximately 4 years and 10 months, i.e. it will be targeted to end on March 31st 2027.
Contractors should not rely on any indicative expenditure or volume levels stated as a commitment of the total value the Contract that will be awarded by Broadacres. Broadacres offers no guarantee to potential suppliers on the value of the Contract. The Contract will not be awarded on the basis of exclusivity, Broadacres will retain the option to source the requirements stipulated in the Contract from other contractors if necessary. The minimum expected specification and the schedule of services are provided in Appendix A.

Contractors are expected to meet and/or exceed these requirements. The Contract is envisaged to use the JCT Measured Term Contract 2016, as adjusted based on requirements of Broadacres. Broadacres reserve the right to implement an alternative form of contract prior to award if considered appropriate.
TUPE
The incumbent contractor has confirmed that the terms of the Transfer of Undertakings (Protection of Employment) Regulations 2006 as amended (hereafter collectively referred to as “TUPE”) will not apply to existing workforce they have employed in relation to the services to be performed by the successful Contractor following this tender process.
Broadacres cannot and does not guarantee the validity or accuracy of this statement and hereby is excluded from any liability arising from such. Contractors are therefore requested to submit their tender on the basis that the TUPE will not apply.

Broadacres will incorporate a minimum 10 calendar day (when using electronic means) standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to challenge the decision to award the contract before it is executed/signed.
The Public Contracts Regulations 2015 (‘Regulations’) provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly and within the time limits as defined in the above regulations. Where a contract has not been entered into the court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If the contract has been entered into the court has the options to award damages and/or to shorten or order the contract ineffective.
