Explanation:
Following a successful quotation exercise Stepping Stones were awarded a short term contract for the provision of catering services at Lagan Valley Island.
In order to establish a longer term contract, a Tender process to establish a Franchise Agreement was let in August 2022, unfortunately this procurement proved unsuccessful with no responses received. The hospitality industry continues to face many challenges as a result of the pandemic, significantly in terms of staff and inflationary pressures with the rising cost of ingredients and utility charges.
The incumbent supplier has the capacity to deliver the required service under the terms of the original quotation. The council are content that the rates still represent value for money in terms of the original procurement.
This direct award is permitted In line with Regulation 32 of the Public Contract Regulations 2015
32.(2)(a) where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests;
