CWEIC is the commercial, not-for-profit membership organisation with an official mandate from the Commonwealth Heads of Government to facilitate trade and investment throughout the 54 Commonwealth member nations. The role of the CWEIC is to use the convening power and trusted network of Commonwealth, led by her majesty the Queen to drive trade and investment into the UK and West Midlands. CWEIC network includes around 100 business and government Strategic Partners and is instrumental in hosting the Commonwealth Heads of Government Meeting (CHOGM) every 2 years. CWEIC will deliver the Commonwealth Business Forum in advance of the Commonwealth Games, as it has delivered similar Business Forums at the Games in Glasgow and the Gold Coast. CWEIC believes that the Commonwealth is the perfect lens through which to promote the West Midlands. The Commonwealth's shared history, diaspora populations, common language and global respect for Her Majesty as Head of the Commonwealth creates considerable trading advantage. It is widely acknowledged that it is 21% cheaper to do business between Commonwealth countries - this "Commonwealth Advantage" as it is known, is an under-utilised resource.

The West Midlands Growth Company seeks to engage with business leaders and Government decision makers across the Commonwealth by utilising the CWEIC vast network, attend events, industry focused webinars and meet with international delegations. This will provide the West Midlands Growth Company with an opportunity to present its offer of why the West Midlands to senior decision makers across multiple Commonwealth regions.

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

It is the intention of WMGC Ltd to directly award Commonwealth Enterprise & Investment Council the contract due to the nature of the service required and in line with principles set in PPN01/20 where direct award is permissible due absence of competition and protection of exclusive rights under Regulation 32 (2) of the PCR which allows for sole supplier sourcing through use of a negotiated procedure without prior publication to be used and this request also falls within Regulation 32 (5) delivery of services by an existing supplier to where competition is absent due to technical reasons.

Furthermore, there is protection of exclusive rights, including intellectual property rights where there is no reasonable alternative or substitutes that exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.

In the case of this procurement competition is absent and only one supplier can provide the expertise required to produce the product or has capacity to complete on the scale required.
