four.1) Description
four.1.1) Type of procedure
Negotiated without a prior call for competition

Explanation:
Salisbury NHS Foundation Trust ("SFT") awarded a contract under Regulation 32(2)(b)(ii), to Healthnet Homecare UK Ltd. (hereafter referred to as "Healthnet") in respect of Fertility Homecare Services, for a period of three (3) years, with no option to extend. This is to maintain continuation of service delivery for privately funded patients both currently undertaking and due to begin IVF treatment at SFT. This will also align this contract with an overarching agreement for Homecare Services, facilitated through the Peninsula Purchasing and Supply Alliance ("PPSA"), allowing for the entire service to be re-tendered, to ensure greater efficiency when procuring services. Healthnet is the incumbent supplier for privately funded patients at SFT and the new contract will ensure that the current service is maintained until the re-tender is complete, without risk to patient care or the accumulation of cost and resource pressures. To award another supplier a temporary arrangement of this nature may result in the following:
Trust Turnaround Times and Patient Care: Variations in turnaround time while new systems are set up. Currently Healthnet routes for the provision of Homecare services are established and consistent, with adequate governance surrounding Data Protection in place. Risking this could lead to increased Turnaround and delays to the provision of Homecare services for patients, including those already partway through treatment plans.
Packaging and Transport: New routes of transport for Pharmaceuticals would have to be set up. This would create uncertainties for both the Trust and the patients that existing processes could be upheld, including delivery times, delivery windows, care for packaging and prevention of breakages. Packaging requirements may also vary, leading to additional costs of purchase, and increased time to carry out alternative packaging requirements.
IT and Data Requirements: New setup processes would need to be tested and agreed, to allow patient data to be shared. This would create a time delay, meaning planned deliveries could be missed resulting in ineffective treatment for patients.
Documentation: Changing providers will result in numerous document updates that will place an onerous burden on the department’s quality systems administration.
Accreditation: HFEA would have to be informed of any changes in provider, and any changes in process, which may impact the service provided to patients.
SFT has reviewed the factors described and considers that for the technical reasons listed, awarding to Healthnet is the only reasonable solution as it mitigates the risk of a detrimental effect on the service and the accumulation of preventable cost and resource pressures until the re-tender.
