Explanation:
DWP has procured software and support from IBM UK Ltd to support multiple systems and applications for delivering DWP business requirements.
DWP relied on Regulation 32 to award contract directly to IBM UK Ltd. This is explained as follows:
Regulation 32 (2) (b) (ii) competition is absent for technical reasons: The underpinning platform(s) supporting multiple systems and applications are based on legacy IBM infrastructure and products. Therefore, for these systems, IBM is the only supplier that can ensure it successfully meets required business functional requirements.
Regulation 32 (2) (b) (ii) No reasonable alternative or substitute exists: The legacy applications rely on IBM products which have already been procured, as such there are no reasonable alternative or substitute services available from any alternative software provider/third party.
Regulation 32 (2) (b) (ii) The absence of competition is not the result of an artificial narrowing down of the parameters of the procurement: The parameters of the procurement have not been artificially narrowed given the underlying technology infrastructure is already on DWP's estate and the required legacy applications and systems rely on that technology infrastructure being effectively maintained.
